WIVOR Facial Search Consent and Biometric Data Release Consent presented before selfie upload Last updated: September 8, 2026 | Version: 1.0 NOTICE AND WRITTEN CONSENT This Facial Search Consent and Biometric Data Release (the "Consent") explains how WiVor Photos LLC ("WiVor," "we," "us," or "our") collects, uses, stores, discloses, and destroys information generated when you upload a selfie to locate photographs that may depict you or a minor for whom you are the parent or legal guardian. Please read it before selecting "I Agree" and uploading an image. 1. What the facial-search feature does When you voluntarily upload a selfie, our technology analyzes facial features and may generate a mathematical representation, face geometry, template, embedding, or similar data (collectively, "Facial Search Data"). Depending on applicable law, Facial Search Data may be considered a biometric identifier or biometric information. The system compares that data with features detected in photographs made available for the selected event and returns possible matches for your review. Facial search is only a discovery tool. It does not confirm identity, and results may include missed matches or photographs of another person. 2. Data collected For the facial-search request, WiVor may process: • the selfie or other facial image you voluntarily upload; • Facial Search Data derived from that image and, where needed for matching, from event photographs; • the event identifier, search date and time, device or browser information, IP address, consent version, and records showing your affirmative acceptance; and • contact or account information you provide, if the search is connected to an account or purchase. 3. Purpose and authorization You authorize WiVor and its contracted facial-search and hosting service providers to collect, capture, receive, possess, process, and use the uploaded image and Facial Search Data solely to: • perform the facial comparison you request and display likely matching event photographs; • maintain security, prevent fraud or misuse, troubleshoot the requested service, and document compliance; and • comply with applicable law or a valid legal process. WiVor will not use Facial Search Data to determine your identity, authenticate access, infer sensitive characteristics, make eligibility decisions, track you across events or services, train a general-purpose facial-recognition model, or advertise to you based on your face, unless WiVor first gives a new legally sufficient notice and obtains any additional consent required by law. 4. Choice to consent; access requires facial search You are not required to provide this Consent or upload a selfie. However, facial search is the method WiVor uses to provide access to event-photo results. WiVor does not offer gallery browsing, bib-number search, time or location search, or another non-biometric method for accessing those results. If you decline this Consent, you will not be able to use WiVor to view matching event photographs or purchase them. You may leave the facial-search process without uploading an image. 5. Disclosure and service providers WiVor may disclose the uploaded image and Facial Search Data only to contracted service providers that need the information to operate the requested search, host or secure the service, or comply with law. Such providers must process the information only on WiVor's instructions, protect it using reasonable safeguards, and not sell it or retain, use, or disclose it for unrelated purposes. WiVor does not sell, lease, trade, or otherwise profit from your Facial Search Data. Revenue from the sale of photographs is not a sale of your Facial Search Data. WiVor may also disclose information when required by law, court order, or valid legal process, or when reasonably necessary to protect users, investigate fraud, or establish or defend legal claims, to the extent permitted by applicable law. 6. Retention and destruction WiVor will retain the uploaded selfie and Facial Search Data only for as long as reasonably necessary to complete the requested search, maintain security, prevent fraud or misuse, document compliance, and satisfy applicable legal obligations. WiVor will delete or destroy the uploaded selfie and Facial Search Data in accordance with its published biometric retention and destruction policy and applicable law. WiVor will not retain biometric identifiers or biometric information longer than permitted by applicable law. This retention provision applies to the uploaded selfie and derived Facial Search Data. It does not require deletion of event photographs, purchase records, ordinary account data, or the consent record, which may be retained under WiVor's Privacy Policy, contractual obligations, and applicable law. 7. Security WiVor will use a reasonable standard of care to store, transmit, and protect Facial Search Data, applying protections that are at least as protective as those used for other confidential and sensitive information. No system is completely secure, and WiVor cannot guarantee that unauthorized access or a security incident will never occur. 8. Your image and limited license You retain any rights you have in the image you upload. You grant WiVor and its contracted providers a limited, non-exclusive, non-transferable (except to those providers), royalty-free license to host, reproduce, analyze, and process the image only for the purposes described in this Consent. This license ends when the image is deleted, except for any limited retention required by law or for claims and compliance records. 9. Your representations By uploading an image, you represent and warrant that: • you are at least 18 years old and have legal capacity to give this Consent; • the uploaded image depicts you, or depicts a minor for whom you are the parent or legal guardian with authority to consent; • you will not upload an image of another adult or of a minor for whom you lack legal authority; • you are requesting the search for a lawful, personal purpose and will not use results to harass, stalk, discriminate against, impersonate, or harm another person; and • the information you provide in connection with the search is accurate. 10. Minors A minor may not provide this Consent or upload a facial image independently. If the search concerns a minor, the parent or legal guardian must complete the process and affirm that the guardian has authority to consent to the collection and processing described here and that the search is in the minor's best interests. WiVor may request reasonable verification of the guardian's identity and authority and may refuse or end a search if authority cannot be verified. 11. Event photographs and third-party rights This Consent covers only your voluntary use of WiVor's facial-search feature. It does not itself authorize a photographer, event organizer, venue, or other person to photograph, publish, license, or sell an image. Photographers and event organizers remain responsible under their separate agreements and applicable law for permissions relating to image capture, publicity, and event participation. Copyright in event photographs ordinarily remains with the photographer or other identified rights holder, subject to the license accompanying a purchase. 12. Release; limits required by law To the fullest extent permitted by law, you release and hold harmless WiVor and its officers, employees, and contracted providers from claims arising solely from the authorized collection and processing described in this Consent, including claims based on an inaccurate facial-search match or failure to locate a photograph. This release does not apply to conduct outside this Consent, a violation of applicable biometric privacy law, gross negligence, willful misconduct, or any right or remedy that cannot lawfully be waived. 13. Withdrawal and privacy requests You may withdraw consent for future processing or request access, correction, or deletion where applicable by contacting [PRIVACY EMAIL] or using [PRIVACY REQUEST URL]. Withdrawal does not make prior lawful processing invalid. If a search is underway, WiVor will stop the search when reasonably feasible and delete covered data according to Section 6, subject to lawful exceptions. WiVor may verify your identity before fulfilling a request. 14. Related policies; changes This Consent supplements WiVor's Privacy Policy and Terms of Use. If there is a conflict concerning Facial Search Data, this Consent controls unless applicable law provides greater protection. Material changes to the purposes, recipients, or retention of Facial Search Data will apply prospectively, and WiVor will provide a new notice and obtain renewed consent when required. 15. Electronic signature By selecting the checkbox or button below and uploading an image, you acknowledge that you have read and understood this Consent and voluntarily provide a written release and electronic signature authorizing the collection, capture, possession, disclosure to contracted providers, use, storage, and destruction of the uploaded image and Facial Search Data as described above. You agree that electronic records of your acceptance satisfy any requirement that this authorization be in writing.
