# WivorPhotos Privacy Policy

WivorPhotos (“WivorPhotos,” “Wivor,” “we,” “us,” or “our”) operates an event photography platform that allows photographers to upload and sell event photographs and allows customers to find, preview, purchase, and securely download photographs from participating events.

This Privacy Policy explains what information we collect, how we use and protect it, how certain image-recognition features work, and the choices available to you when you use WivorPhotos.

By using WivorPhotos, you acknowledge the practices described in this Privacy Policy.

## 1. Information We Collect

The information we collect depends on how you use WivorPhotos.

### Information from Customers

Customers can browse events and purchase photographs without creating a customer account.

When you browse or purchase photographs, we may collect:

* Name and email address associated with an order
* Event and photograph selections
* Shopping cart and session information
* Order and transaction identifiers
* Payment status
* Download and fulfillment information
* Customer support communications
* Photo-removal requests
* Bib numbers you voluntarily enter into event searches
* Selfie images you voluntarily submit when using facial search, where that feature is available
* Technical information such as IP address, browser type, device information, timestamps, and security or application logs

### Information from Photographers

Photographers may provide information including:

* Name
* Email address
* Contact information
* Business or professional information
* Login credentials
* Event ownership or assignment information
* Uploaded photographs and related metadata
* Sales and earnings information
* Stripe Connect onboarding and account-status information
* Verification, approval, or account-status information
* Communications with WivorPhotos

Photographers are responsible for ensuring that they have the rights, permissions, and authority necessary to upload and publish photographs through WivorPhotos.

## 2. Event Photographs

Photographers upload photographs associated with events.

These photographs may depict event participants, spectators, photographers, staff, volunteers, or other individuals who were present at the event.

WivorPhotos processes photographs for purposes that may include:

* Creating thumbnails
* Creating watermarked previews
* Making photographs available in event galleries
* Detecting bib numbers
* Creating facial-search indexes when facial search is enabled
* Supporting purchases and secure digital delivery
* Preventing duplicate or invalid uploads
* Enforcing media-retention and removal rules

Original photographs are intended to remain private and are not used as the normal public gallery image.

Customers generally view separately generated watermarked preview images before purchase.

## 3. Bib-Number Recognition

WivorPhotos may use Amazon Rekognition or similar image-processing technology to detect visible bib numbers in event photographs.

This processing may identify numeric text appearing in a photograph and associate the detected bib number with that photograph.

Customers may then search an event using a bib number to locate photographs that may contain that number.

Bib recognition is an assistive search feature.

We do not guarantee that every bib number will be detected correctly or that every photograph containing a particular bib number will appear in search results.

## 4. Facial Search and Facial Recognition

WivorPhotos may offer an optional facial-search feature for participating events.

The purpose of this feature is to help a customer locate event photographs that may contain a person who visually resembles the person shown in a submitted selfie.

### Customer Selfie Search

When facial search is enabled, a customer may voluntarily upload a JPEG or PNG photograph containing a clear image of their face.

Before submitting the image, the customer must provide explicit consent to use the image for the face-search request.

The submitted selfie is:

* Received temporarily as part of the search request
* Read by the WivorPhotos application
* Sent to Amazon Rekognition for facial similarity matching
* Used only to search the selected event's facial index
* Not intentionally uploaded by WivorPhotos to permanent S3 storage
* Not intentionally stored in the WivorPhotos database
* Not intentionally stored in the customer's session
* Not placed into a background-job queue
* Not intentionally retained by WivorPhotos after the search request is completed

Amazon Web Services may process the submitted image as our service provider in order to perform the requested facial comparison.

### Event Photograph Indexing

When facial search is enabled, WivorPhotos may also process faces appearing in published event photographs using Amazon Rekognition.

Amazon Rekognition may create mathematical facial-feature information associated with faces detected in those photographs.

WivorPhotos associates those indexed faces with the corresponding WivorPhotos photograph so that later selfie searches can return potential matching photographs.

WivorPhotos does not use this feature to determine a person's legal identity, name, account ownership, ethnicity, or other unrelated personal characteristics.

The feature is intended solely to help locate photographs within a particular event.

### Face Index Removal

WivorPhotos is designed to remove associated indexed face information when a photograph is unpublished, removed, or expires under applicable media-retention rules.

Facial search is probabilistic. A result may include false matches or may fail to identify photographs that actually contain the person being searched for.

## 5. Payments

Payments are processed through Stripe.

When you make a purchase, payment information is provided to Stripe and processed according to Stripe's privacy and security practices.

WivorPhotos does not need to store your complete payment-card number in order to provide the service.

We may receive transaction-related information from Stripe such as:

* Payment status
* Checkout-session identifiers
* Transaction identifiers
* Amount paid
* Currency
* Refund or dispute status
* Customer contact information associated with the transaction

We use this information to fulfill orders, prevent duplicate fulfillment, provide downloads, maintain financial records, and respond to refunds or disputes.

## 6. Photographer Payments and Stripe Connect

Photographers may connect or onboard an account through Stripe Connect.

WivorPhotos may receive information about whether a photographer's Stripe account has completed onboarding or is able to receive payments.

WivorPhotos also records photographer sales allocations and payout-related status.

Current payout transfers may be handled separately from the customer checkout transaction and should not be interpreted as an automatic transfer after every individual sale.

Stripe independently processes information submitted through its onboarding and payment systems.

## 7. Photo Storage and Delivery

WivorPhotos uses cloud storage, including Amazon Web Services, to store event photographs and related media.

Our current architecture is designed so that:

* Original photographs are stored privately
* Public customers normally receive watermarked preview images
* Purchased original photographs require an authorized order
* Access to purchased originals is provided through protected and time-limited delivery mechanisms
* Order access may expire after the applicable download period

We may retain order information beyond the download period when reasonably necessary for accounting, fraud prevention, customer support, legal compliance, and business records.

## 8. Email Communications

We may use your email address to send transactional communications such as:

* Purchase receipts
* Secure order-access links
* Photographer verification messages
* Password-reset messages
* Photographer account or onboarding information
* Customer-support responses
* Important service or security notices

We may use third-party email-delivery providers to send these messages.

Transactional messages are necessary to complete or support actions you request through WivorPhotos.

## 9. Cookies and Sessions

WivorPhotos uses cookies or similar session technologies necessary to operate the service.

These may be used for purposes such as:

* Maintaining shopping-cart contents
* Maintaining authenticated photographer or administrator sessions
* Protecting forms against unauthorized requests
* Preserving security and application state

Customers do not need to create an account to browse events or complete the normal guest checkout process.

## 10. How We Use Information

We use information collected through WivorPhotos to:

* Operate event galleries
* Process and fulfill photograph purchases
* Provide secure downloads
* Operate shopping carts and sessions
* Process photographer applications
* Manage photographer and event access
* Process uploaded photographs
* Detect bib numbers
* Provide optional facial search
* Communicate about transactions and accounts
* Process photo-removal requests
* Prevent fraud and misuse
* Troubleshoot technical problems
* Maintain security
* Maintain financial and operational records
* Comply with legal obligations
* Enforce our Terms and applicable policies

We do not use customer selfie images to create advertising profiles.

## 11. How We Share Information

We may share information with service providers when reasonably necessary to operate WivorPhotos.

These providers may include:

### Amazon Web Services

Used for cloud infrastructure, private image storage, image processing, bib recognition, and facial-search functionality.

### Stripe

Used for payment processing and Stripe Connect photographer onboarding.

### Email Service Providers

Used to deliver receipts, verification messages, password-reset links, support messages, and other transactional communications.

### Hosting, Security, and Infrastructure Providers

Used to operate, protect, monitor, and maintain WivorPhotos.

We may also disclose information when reasonably necessary to:

* Comply with law, regulation, subpoena, court order, or lawful governmental request
* Investigate fraud or security incidents
* Protect customers, photographers, event participants, WivorPhotos, or others
* Enforce our agreements and policies
* Complete a merger, acquisition, financing, restructuring, or sale of business assets, subject to applicable law

We do not sell customer selfies or facial-search data to advertisers.

## 12. Data Retention

We retain information only for as long as reasonably necessary for the purposes for which it was collected, subject to operational, contractual, accounting, security, and legal requirements.

Retention periods may vary depending on the type of information.

For example:

* Event photographs are subject to WivorPhotos media-retention rules.
* Purchased-order records may be retained for financial, support, and legal purposes.
* Photographer account and sales information may be retained while an account is active and as needed for legitimate business records.
* Indexed facial information associated with a photograph is designed to be removed when the corresponding photograph is unpublished, removed, or expires under applicable retention rules.
* Customer face-search selfies are not intentionally retained by WivorPhotos after the search request has completed.

Backup systems and third-party service providers may retain information for additional limited periods according to their security, recovery, and legal-retention practices.

## 13. Photo Removal Requests

If you believe a photograph depicting you or someone for whom you are legally responsible should be removed, WivorPhotos provides a photo-removal request process.

Submitting a removal request does not guarantee automatic removal. We may review the request, verify relevant information, and consider applicable rights, obligations, event circumstances, and law.

## 14. Children and Minors

WivorPhotos is not intended for children to independently create accounts or make purchases in violation of applicable law.

Event photographs may include minors participating in sports, fitness, school, community, or similar events.

Photographers and event organizers are responsible for obtaining any permissions or authority required for photography and publication of event images.

## 15. Security

We use technical and organizational safeguards designed to protect information handled by WivorPhotos.

Depending on the information involved, these safeguards may include:

* Private cloud storage
* Restricted access controls
* Authentication and authorization
* Secure HTTPS connections
* Watermarked public previews
* Temporary signed download URLs
* Random order-access tokens
* Limited administrative access
* Background processing controls
* Logging and monitoring

No internet service or storage system can guarantee absolute security.

## 16. Your Privacy Choices and Rights

Depending on where you live, applicable law may provide rights regarding your personal information.

These rights may include the ability to request:

* Access to personal information
* Correction of inaccurate information
* Deletion of certain information
* Information about how data is used or disclosed
* Withdrawal of consent for certain processing

## 17. Facial Search Consent

Facial search is optional for customers.

Where WivorPhotos presents a facial-search feature, we require the customer to affirmatively agree to the use of the submitted image for that search.

You should submit only an image that you are authorized to use.

Do not submit another person's image for facial search without appropriate authorization.

If you do not wish to use facial search, you can continue to browse event galleries and, where available, use bib-number search.

## 18. Third-Party Services

WivorPhotos relies on third-party services that operate under their own privacy, security, and contractual terms.

These include services such as Amazon Web Services and Stripe.

We encourage users to review the privacy practices of those providers where appropriate.

## 19. International and Interstate Processing

WivorPhotos and its service providers may process information in locations different from the location where the information was originally collected.

By using the service, information may be transferred to and processed through infrastructure operated by our service providers, subject to applicable law and contractual safeguards.

## 20. No Sale of Facial Data

WivorPhotos does not sell facial-feature information, customer selfie images, or facial-search information to advertisers or data brokers.

Facial-search processing is used for the limited purpose of helping users locate photographs within WivorPhotos event galleries and supporting related operational and security functions.

## 21. Changes to This Privacy Policy

We may update this Privacy Policy as WivorPhotos changes or as legal, operational, or technical requirements evolve.

When we make material changes, we will update the “Last Updated” date and may provide additional notice where appropriate.

Your continued use of WivorPhotos after an updated Privacy Policy becomes effective is subject to the updated policy.
